I. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your access to and use of quarrymansrest.com and its subdomains (collectively, the “Site”), as well as online services, forms, features, content, promotions, communications, and other services made available by Quarryman’s Rest, LLC (“Quarryman’s Rest,” “we,” “us,” or “our”) that expressly incorporate or link to these Terms.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Site.

Certain activities may require you to affirmatively accept these Terms or additional terms before participating.

II. About Quarryman’s Rest

Quarryman’s Rest, LLC is a West Virginia limited liability company developing and operating Quarryman’s Rest, a historic lodging and immersive interpretive experience in Bakerton, West Virginia.

Our Site currently documents the restoration and development of the property, presents historical and interpretive material, allows visitors to join our waitlist and mailing list, invites historical contributions, provides opportunities to contact or interact with us, and may offer promotions and other features.

As Quarryman’s Rest develops, the Site may also provide reservations, purchases, events, memberships, guest accounts, interactive features, and other services.

III. Additional Agreements

These Terms are our general terms governing the Site and related services.

Some activities are or may be governed by additional agreements, including:

  • Our Privacy Policy;
  • Historical Contribution Agreement;
  • Donation or Deed of Gift documentation;
  • Promotion-specific terms;
  • Reservation or Rental Agreement;
  • House Rules;
  • Event terms;
  • Purchase or ticket terms;
  • Media or photography releases; and
  • Other terms presented in connection with a particular service.

When additional terms apply, they supplement these Terms.

If there is a direct conflict, the more specific agreement will control with respect to the subject it specifically governs. For example, a Rental Agreement will control the terms of a particular direct reservation, and specific promotion rules will control a promotion to the extent they differ from the general promotion provisions below.

USING OUR SITE

IV. Eligibility

You must be legally capable of entering into a binding agreement to use portions of the Site that require contractual consent. Our Site is intended for a general audience and is not directed to children under 13. Children under 13 may not independently submit personal information through our Site.

Our waitlist, mailing list, and independent historical-contribution process are intended for adults age 18 or older unless we expressly provide otherwise or participation occurs with appropriate parent or legal guardian involvement. Additional age requirements may apply to particular activities.

The minimum age to make a lodging reservation directly with Quarryman’s Rest is expected to be 21 years, and the person making the reservation must be present during the stay unless we expressly agree otherwise in writing.

V. Accounts

We may offer user accounts in the future.

If you create an account, you are responsible for:

  • Providing accurate and current information;
  • Maintaining the confidentiality of your credentials;
  • Restricting unauthorized access to your account; and
  • Promptly notifying us if you reasonably believe your account has been compromised.

You are responsible for activity occurring through your account to the extent permitted by law.

We may suspend, restrict, or terminate accounts that violate these Terms, threaten our systems or users, appear fraudulent, or are otherwise misused.

VI. Acceptable Use

You agree not to misuse the Site or our services.

Among other things, you may not:

  • Violate applicable law;
  • Submit fraudulent, deceptive, or materially false information;
  • Impersonate another person or organization;
  • Harass, threaten, abuse, or unlawfully discriminate against another person;
  • Submit unlawful, defamatory, obscene, abusive, malicious, or infringing material;
  • Transmit malware or malicious code;
  • Attempt to gain unauthorized access to the Site, servers, accounts, networks, or systems;
  • Circumvent security or access controls;
  • Interfere with or disrupt Site operation;
  • Overload or intentionally degrade our infrastructure;
  • Probe or test vulnerabilities without written authorization;
  • Reverse engineer protected systems except where such restriction is prohibited by law;
  • Use forms for spam, unsolicited advertising, harassment, or automated submissions;
  • Manipulate promotions, reservations, waitlists, quizzes, voting systems, or other features;
  • Harvest personal information about other users;
  • Use automated systems to extract Site content in violation of these Terms; or
  • Assist another person in doing any of the foregoing.

We may restrict access, reject submissions, remove content, invalidate promotion entries, suspend accounts, or take other reasonable action in response to suspected misuse.

OUR CONTENT & INTELLECTUAL PROPERTY

VII. Quarryman’s Rest Content

Except where otherwise stated, original material created or commissioned for Quarryman’s Rest—including original text, research presentation, graphics, illustrations, photographs, video, audio, branding, logos, website design, interactive materials, compilations, and other original content—is owned by or licensed to Quarryman’s Rest, LLC and is protected by applicable intellectual-property laws.

Nothing on the Site transfers ownership of our intellectual property to you.

VIII. Limited Personal Use

Unless we expressly provide otherwise, the Site is provided for personal, informational, educational, and noncommercial use.

You may view and reasonably reference Site content for those purposes.

You may not, without permission:

  • Republish substantial portions of the Site;
  • Reproduce our photographs or graphics for independent use;
  • Mirror the Site;
  • Create a competing archive or database from our content;
  • Commercially exploit our content;
  • Sell or license our content;
  • Systematically download or extract content;
  • Remove copyright notices, credits, watermarks, metadata, or provenance information; or
  • Falsely represent our material as your own.

IX. Quotation, Sharing & Scholarly Use

We welcome legitimate interest in Bakerton's history.

Reasonable quotations from our original written material for commentary, scholarship, journalism, education, or similar purposes may be made where permitted by law, and we appreciate appropriate attribution to Quarryman’s Rest.

Ordinary sharing of links to our Site is welcome.

Our original social-media content may generally be shared using the sharing functions provided by the relevant platform.

These Terms do not restrict any use independently permitted by copyright law, including applicable fair-use rights.

X. Historical & Third-Party Material

Some historical photographs, documents, maps, quotations, archival materials, or other items appearing on the Site may be owned by contributors, archives, libraries, government institutions, photographers, descendants, or other third parties, or may have a copyright status different from our original material.

The fact that historical material appears on our Site does not mean Quarryman’s Rest owns the underlying material, nor does its appearance grant you permission to reproduce it.

You are responsible for determining the copyright status and obtaining any necessary permission before independently reusing third-party material.

Credits and source information should not be removed.

XI. Quarryman’s Rest Name, Logos & Branding

The Quarryman’s Rest name, logos, visual identity, and other distinctive branding may not be used in a way that:

  • Implies sponsorship or endorsement;
  • Creates confusion about affiliation;
  • Misrepresents the source of goods or services; or
  • Otherwise violates applicable intellectual-property law.

Approved press assets may be used in accordance with the permissions and conditions supplied with those assets.

XII. Automated Scraping & Artificial Intelligence

Except for ordinary indexing by legitimate public search engines, or where otherwise authorized by us or applicable law, you may not use automated means to systematically scrape, harvest, reproduce, extract, download, or compile substantial portions of our Site or original content.

To the extent permitted by applicable law, our original content may not be systematically collected or reproduced for the purpose of:

  • Training artificial-intelligence or machine-learning models;
  • Creating training datasets;
  • Fine-tuning generative systems;
  • Building competing databases;
  • Large-scale automated text or image extraction; or
  • Developing commercial products derived substantially from our protected content

without prior written permission.

Nothing in this section restricts uses that cannot lawfully be restricted by contract or applicable intellectual-property law.

HISTORICAL CONTENT

XIII. Historical Accuracy & Interpretation

Historical accuracy matters deeply to Quarryman’s Rest. We make good-faith efforts to research and responsibly present the people, places, industries, and events we interpret.

History, however, is not always complete. Records may be missing, contradictory, illegible, misidentified, incomplete, inaccurate, or subject to differing interpretations. New evidence may change what is known.

Accordingly, we do not guarantee that every historical statement, identification, date, relationship, interpretation, or other historical detail presented through the Site or experience is complete or error-free. We reserve the right to correct, expand, reconsider, or revise historical material as new evidence or better information becomes available.

XIV. Reconstruction & Dramatization

Quarryman’s Rest is intended to do more than display historical facts. It is being designed to create an immersive interpretation of Bakerton's working-class past.

Where the historical record is incomplete, experiences may incorporate reasonable reconstruction, inferred details, reconstructed dialogue, sound design, dramatization, composite presentation, artistic interpretation, or other storytelling techniques.

Such presentation should not be understood as a representation that every word, sound, interaction, or depicted detail occurred exactly as presented.

Where appropriate, we may distinguish documented history from reconstruction or interpretation, but these Terms do not require every interpretive element to carry an individual label or disclaimer.

XV. No Professional or Legal Reliance

Historical, genealogical, architectural, preservation, or other informational content provided through Quarryman’s Rest is offered for educational, interpretive, and entertainment purposes.

It is not legal, financial, genealogical-certification, title, probate, citizenship, medical, engineering, architectural, or other professional advice.

Do not rely upon Site content as the sole basis for determining legal rights, ownership, inheritance, citizenship, title, lineage, or another matter requiring authoritative documentation or professional advice.

HISTORICAL CONTRIBUTIONS & DONATIONS

XVI. Contributions

Quarryman’s Rest welcomes historical photographs, stories, documents, research, recordings, family information, and other material relating to Bakerton and its people.

Contributions may be governed by a separate Historical Contribution Agreement, which you may be required to accept before submission.

By submitting material, you represent that the information you provide concerning your rights and authority to submit it is truthful. We may accept, decline, edit, contextualize, excerpt, preserve, archive, publish, or choose not to use a contribution. Submission does not guarantee publication, display, attribution, incorporation into the house, or any other use.

XVII. Ownership of Digital Contributions

Unless a separate written agreement expressly provides otherwise, submitting a digital copy does not transfer ownership of the contributor's underlying original copyright or physical object to Quarryman’s Rest.

However, by submitting material under our Historical Contribution Agreement, the contributor grants Quarryman’s Rest the rights specified in that agreement.

Those rights may include a perpetual, worldwide, nonexclusive, irrevocable, transferable, sublicensable, royalty-free license to possess and use our copies of the submitted material, including to:

  • Preserve;
  • Archive;
  • Digitize;
  • Reproduce;
  • Crop;
  • Resize;
  • Restore;
  • Adapt;
  • Edit;
  • Transcribe;
  • Excerpt;
  • Translate;
  • Display;
  • Perform;
  • Publish;
  • Distribute;
  • Incorporate into other works;
  • Create derivative materials; and
  • Otherwise use the contribution as permitted by the applicable agreement.

Permitted uses may include:

  • The physical Quarryman’s Rest property;
  • Immersive experiences;
  • Exhibits;
  • Websites;
  • Social media;
  • Advertising;
  • Promotional material;
  • Press material;
  • Educational material;
  • Printed publications;
  • Commercial publications;
  • Merchandise where permitted by the applicable release;
  • Paid experiences;
  • Presentations; and
  • Future Quarryman’s Rest projects.

Unless separately agreed in writing, such use does not create a right to royalties or other compensation.

XVIII. Contributor Representations

A contributor must have the legal authority to make the contribution and grant the permissions being requested.

Depending upon the contribution, the contributor may be required to represent that:

  • They own the material or possess sufficient authority to submit it;
  • They have authority to grant the applicable license;
  • The contribution does not knowingly infringe copyright or other intellectual-property rights;
  • The contribution does not improperly violate another person's privacy, publicity, confidentiality, or other rights;
  • Required permissions concerning living persons have been obtained where applicable; and
  • Information supplied concerning provenance, authorship, ownership, or permissions is accurate to the contributor's knowledge.

Contributors may be responsible for claims arising from material submitted without necessary rights or permissions as further provided in the Historical Contribution Agreement and these Terms.

XIX. Attribution & Anonymity

Where available, contributors may request public attribution or anonymity.

We may maintain internal information concerning the source, provenance, ownership history, permissions, and contributor of historical material even when the contributor is not publicly identified.

We do not guarantee that attribution will accompany every subsequent reproduction or use unless specifically agreed in writing.

XX. Removal Requests

Historical contributions may become incorporated into research, exhibits, interpretive material, publications, advertising, archival collections, or other projects. Accordingly, Quarryman’s Rest does not generally guarantee withdrawal or removal after a contribution has been accepted and used.

We will, however, consider legitimate requests involving:

  • Copyright;
  • Privacy;
  • Living persons;
  • Confidentiality;
  • Misidentification;
  • Safety;
  • Legal requirements; or
  • Other substantial concerns.

XXI. Physical Donations

A physical historical object does not become Quarryman’s Rest property merely because someone shows it to us, lends it to us, temporarily leaves it with us, or permits us to photograph or digitize it.

A transfer of ownership requires an intentional donation or other affirmative transfer.

When a physical item is intentionally and unconditionally donated to Quarryman’s Rest, LLC and accepted by us, title to the donated property transfers to Quarryman’s Rest, LLC to the extent the donor possesses lawful title and authority to transfer it.

Unless a written agreement expressly restricts our rights, Quarryman’s Rest may thereafter preserve, conserve, display, photograph, reproduce, digitize, store, relocate, lend, exhibit, publish, transfer, sell, deaccession, dispose of, or, when reasonably appropriate, destroy the donated property.

A donor should not donate an object unless they intend to permanently relinquish ownership.

XXII. Irreplaceable Originals

Do not mail, ship, leave, or deliver an irreplaceable original historical object or document to Quarryman’s Rest unless we have specifically agreed in advance to receive it.

Submission of a digital copy is ordinarily preferable.

Separate documentation may govern physical loans and donations.

XXIII. Copyright & Privacy Concerns

If you believe material appearing through Quarryman’s Rest infringes a copyright you own or violates legitimate privacy rights, contact:

Please provide enough information for us to identify the material, understand the basis of your claim, and contact you. For copyright matters, include information reasonably sufficient to identify the copyrighted work, the allegedly infringing material, your contact information, and the basis for your claimed rights. Where applicable, we will respond to legally sufficient notices in accordance with applicable copyright law.

Nothing in this section prevents us from adopting a more formal DMCA procedure or designated agent in the future.

WAITLIST & COMMUNICATIONS

XXIV. Waitlist

Joining the Quarryman’s Rest waitlist does not create a reservation or guarantee:

  • An opening date;
  • Any particular booking date;
  • Availability;
  • A particular rate;
  • A particular position in a booking queue;
  • That every proposed feature will be completed; or
  • That you will ultimately make or be able to make a reservation.

Our current intention is to provide waitlist members notice and an opportunity to seek reservations before booking is opened generally to the public.

Priority booking means advance opportunity—not guaranteed availability.

Availability may be limited, and reservations may be offered on terms established when booking opens.

We may modify or discontinue waitlist benefits, remove invalid or duplicate entries, address technical errors, and take reasonable measures against fraudulent or abusive use.

XXV. Opening Dates, Rates & Plans

Until Quarryman’s Rest actually opens and a reservation is confirmed, projected opening dates, pricing, amenities, restoration plans, booking arrangements, and other future plans are subject to change.

Nothing on the pre-launch Site constitutes a guarantee that Quarryman’s Rest will open on a particular date or offer a particular rate, feature, amenity, or experience.

GENERAL PROMOTION TERMS

XXVI. Applicability

From time to time, Quarryman’s Rest may offer sweepstakes, giveaways, contests, drawings, or other promotions (“Promotions”). Unless different or additional rules are provided for a particular Promotion, this section establishes our general Promotion terms.

Where promotion-specific terms conflict with this section, the specific terms control.

XXVII. No Purchase Necessary

Where applicable to a chance-based Promotion:

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE THE ODDS OF WINNING.

Promotions are void where prohibited or restricted by law.

XXVIII. Eligibility

Unless otherwise stated, Quarryman’s Rest Promotions are intended for eligible participants in jurisdictions where the Promotion may lawfully be offered.

Eligibility requirements may vary.

For lodging prizes, a person responsible for the reservation and stay must be at least 21 years old.

If a Promotion permits an eligible winner younger than 21, a lodging prize may be transferable to an eligible person age 21 or older where permitted by the applicable Promotion terms.

We may require reasonable proof of age, identity, or eligibility before awarding a prize.

Employees, contractors, household members, or others connected with administration of a particular Promotion may be excluded where stated or appropriate.

XXIX. Entries

Unless otherwise stated:

  • Entry is limited to one entry per person/email address;
  • Automated, fraudulent, duplicate, manipulated, or otherwise improper entries may be disqualified;
  • Entrants must provide accurate information; and
  • We may verify eligibility before awarding a prize.

The odds of winning depend upon the number of eligible entries received.

XXX. Prizes

Unless otherwise stated:

  • Prizes are not redeemable for cash;
  • A lodging prize is subject to availability and applicable blackout dates;
  • Transfer may be permitted with our approval;
  • Travel to and from Quarryman’s Rest is not included;
  • Meals, transportation, incidentals, and other expenses are not included unless expressly stated;
  • Winners are responsible for taxes and other obligations associated with a prize;
  • A lodging prize remains subject to applicable reservation requirements, Rental Agreement, House Rules, occupancy restrictions, and property policies; and
  • A winner may be required to provide eligibility documentation before receiving the prize.

XXXI. Promotion Administration

Quarryman’s Rest may reasonably suspend, modify, terminate, or cancel a Promotion if fraud, technical malfunction, unauthorized interference, force majeure, legal restrictions, or another circumstance outside our reasonable control compromises its integrity or administration.

If a Promotion is promoted through Facebook, Instagram, or another social platform, that platform is not a sponsor, administrator, or endorser of the Promotion unless expressly stated otherwise.

SOCIAL MEDIA, REVIEWS & USER CONTENT

XXXII. Social Media

You are welcome to tag or mention Quarryman’s Rest on social media.

We may use ordinary platform features to share, repost, react to, or otherwise interact with public content in which Quarryman’s Rest has been tagged or mentioned, subject to applicable law and platform rules.

Use of identifiable guest photography or video outside ordinary platform sharing—particularly in paid advertising or other independent promotional material—may require additional permission where appropriate.

XXXIII. Reviews & Testimonials

We may quote or display reviews, testimonials, feedback, or publicly posted comments about Quarryman’s Rest where lawfully permitted.

We may edit excerpts for length, formatting, spelling, or clarity, provided we do not materially misrepresent the reviewer's meaning.

Use of identifiable photographs or video in advertising may be subject to separate permission or release.

XXXIV. User-Generated Content

If we permit comments, reviews, uploads, discussions, or other user-generated content, we reserve the right, but not the obligation, to moderate, reject, restrict, or remove material that:

  • Violates these Terms;
  • Violates law;
  • Infringes another person's rights;
  • Contains spam;
  • Contains malicious content;
  • Threatens safety or security; or
  • Is otherwise inappropriate for the service.

Our ability to moderate content does not mean we endorse or assume responsibility for everything users submit.

PRESS, MEDIA & CREATORS

XXXV. Press Materials

Journalists and other media professionals may use materials specifically designated as press assets in accordance with any accompanying press-use terms.

Designation as a press asset does not transfer ownership. Press use must not falsely imply endorsement, sponsorship, partnership, or approval by Quarryman’s Rest.

XXXVI. Property Access & Commercial Production

A press inquiry does not guarantee:

  • Property access;
  • Interviews;
  • Preview stays;
  • Complimentary accommodations;
  • Photography;
  • Filming;
  • Access to restricted areas; or
  • Any other accommodation.

Commercial photography, filming, organized content production, or similar commercial use of the property requires prior written approval or an applicable written agreement.

We may enter into separate arrangements with journalists, photographers, filmmakers, influencers, content creators, or other media professionals, including complimentary or discounted stays.

THIRD-PARTY SERVICES

XXXVII. External Websites & Services

Our Site may link to or integrate third-party websites and services, including:

  • Booking platforms;
  • Airbnb;
  • VRBO;
  • Tripadvisor;
  • Mapping and navigation services;
  • Social-media platforms;
  • Payment processors;
  • Tourism attractions;
  • Restaurants;
  • Local businesses;
  • Historical resources;
  • Media providers; and
  • Other third-party services.

Third-party services operate independently and may have their own terms and privacy practices.

We do not control and are not responsible for their availability, accuracy, security, content, products, services, policies, or conduct.

XXXVIII. Maps, Directions & Recommendations

Maps, directions, travel times, distances, weather information, business listings, and similar third-party information are provided for convenience.

Conditions and information may change. You are responsible for using appropriate judgment and current information when traveling.

A link, mention, recommendation, or inclusion of another organization or business does not necessarily constitute endorsement, sponsorship, or affiliation.

XXXIX. Affiliate & Sponsored Content

We may introduce affiliate relationships, sponsorships, advertising, complimentary products or services, or other commercial relationships.

Where disclosure is required by law or appropriate to avoid misleading visitors, we will identify material connections.

FUTURE RESERVATIONS & THE PROPERTY

XL. Separate Reservation Terms

Reservations and stays at Quarryman’s Rest will be governed by additional Reservation/Rental Terms and House Rules.

Those documents will contain the detailed policies applicable to reservations, including payment schedules, cancellation, refunds, security deposits or damage authorizations, check-in and check-out, occupancy, guest responsibilities, and other lodging terms.

The provisions below establish general expectations and do not replace the applicable Rental Agreement.

XLI. General Guest Expectations

Unless otherwise agreed in writing, guests should expect that:

  • The booking guest must meet the applicable minimum booking age;
  • The booking guest must stay at the property;
  • The booking guest is responsible for the conduct of their party;
  • Accurate guest counts are required;
  • Unregistered visitors are not permitted without approval;
  • Maximum occupancy limits must be observed;
  • Quiet hours begin at 10:00 p.m.;
  • Smoking and vaping are permitted only in designated exterior areas, if permitted at all;
  • Illegal drugs and activity are prohibited on the property;
  • Open flames are prohibited except in specifically designated equipment or areas such as an approved outdoor grill or firepit;
  • Guest-hosted parties or events require a separate written agreement;
  • Commercial photography or filming requires written approval;
  • Pet occupancy is generally limited to one permitted pet, subject to applicable pet terms;
  • Service animals will be accommodated as required by applicable law;
  • Children are permitted but must be reasonably supervised; and
  • Some aspects of the experience may be more appropriate for children approximately age five and older.

Final policies will be stated in the applicable Rental Agreement and House Rules.

XLII. Alcohol

Lawful and responsible consumption of alcohol by guests of legal drinking age may be permitted.

Intoxication does not excuse:

  • Unsafe conduct;
  • Excessive noise;
  • Property damage;
  • Interference with other persons;
  • Violation of House Rules;
  • Unauthorized entry;
  • Misuse of antiques or interactive equipment; or
  • Other prohibited conduct.

Guests remain responsible for their actions regardless of alcohol consumption.

HISTORIC PROPERTY & ACCESSIBILITY

XLIII. A Real Historic House

Quarryman’s Rest is not a newly constructed building made to look old. It is a genuine historic house being preserved and adapted for lodging. Historic buildings can have physical characteristics that differ substantially from modern construction.

The property may include:

  • Narrow or irregular stairways;
  • A winding or twisting staircase;
  • Narrow doorways;
  • Small rooms;
  • Limited clearances;
  • Uneven or historic flooring;
  • Changes in elevation;
  • Historic thresholds;
  • Outdoor terrain;
  • Steps;
  • Outbuildings;
  • Firepit or outdoor cooking areas; and
  • Other features inherent to an old property.

Guests should use reasonable care and comply with posted or provided safety instructions.

XLIV. Accessibility

We want prospective guests to have accurate information about the property before deciding whether Quarryman’s Rest is suitable for them.

Because Quarryman’s Rest is a small historic building, its original construction presents accessibility limitations that may not be capable of being fully eliminated without materially altering historic or structural features.

Known or anticipated characteristics include:

  • A narrow, winding staircase;
  • Narrow doorways;
  • Small rooms;
  • Limited maneuvering space; and
  • Other dimensions typical of a small historic house.

Preservation, structural, and physical limitations may constrain some alterations.

Nothing in these Terms is intended to waive or avoid an accessibility obligation imposed by applicable law. We will make reasonable efforts and accommodations where required and practicable.

If you have mobility, accessibility, sensory, or other accommodation questions, please contact us before booking. We would rather explain the property accurately in advance than have you arrive and discover that an important feature does not meet your needs.

XLV. Restricted Areas

If Quarryman’s Rest, LLC or some or all of its assets is involved in a merger, acquisition, financing, reorganization, sale, transfer, or similar transaction, information maintained by the business may be transferred as part of that transaction.

Any successor will remain subject to applicable privacy and data-protection obligations.

IMMERSIVE EXPERIENCE

XLVI. Interactive Historical Environment

Quarryman’s Rest is being designed as an immersive historical lodging experience.

Guests may encounter interactive or atmospheric effects including:

  • Bells;
  • Whistles;
  • Telephone ringing;
  • Mechanical sounds or movement;
  • Lighting changes;
  • Flickering effects;
  • Reduced lighting or darkness;
  • Fog, haze, or theatrical atmospheric effects;
  • Vibration;
  • Sudden sounds;
  • Recorded voices;
  • Period industrial sounds;
  • Quarry-related soundscapes; and
  • Other interactive or sensory effects.

Some effects may occur when a guest intentionally handles, operates, explores, or interacts with a designated object or feature. Although Quarryman’s Rest is not intended to be a horror attraction, some effects may be surprising or sudden.

XLVII. Sensory Considerations

Prospective guests who are particularly sensitive to:

  • Sudden or loud noises;
  • Flashing or flickering lights;
  • Darkness;
  • Fog or haze;
  • Vibration;
  • Unexpected mechanical effects; or
  • Similar sensory experiences

should consider whether the immersive experience is appropriate for them and contact us with questions before booking.

We may provide additional information about disabling or reducing certain effects if such functionality is available. We do not guarantee that every immersive feature can be individually disabled.

XLVIII. Interactive Objects

Guests may be specifically encouraged to touch, operate, or investigate certain designated objects.

Permission to interact is not permission to dismantle.

Guests may not:

  • Remove objects from the property;
  • Force mechanisms;
  • Use excessive force;
  • Dismantle equipment;
  • Modify or alter objects;
  • Attempt repairs;
  • Relocate objects without permission;
  • Tamper with wiring or electronics;
  • Circumvent barriers;
  • Interact with restricted or marked objects; or
  • Use an object in a manner inconsistent with instructions or its intended guest interaction.

Objects not intended for guest handling may be marked, protected, secured, placed behind barriers, or otherwise identified.

XLIX. No Real Industrial Hazards

Immersive props and effects are interpretive.

Guest-accessible interactive experiences will not intentionally expose guests to actual explosives, hazardous industrial machinery, dangerous electrical voltages, or other authentic quarry hazards merely for historical realism.

Historical appearance should never be interpreted as permission to access restricted equipment or ignore safety instructions.

L. Technology Availability

Quarryman’s Rest contains specialized technology.

Like any technology, an interactive feature may occasionally fail, require maintenance, lose power, experience a network problem, or otherwise become temporarily unavailable.

We will make reasonable efforts to maintain the experience and, where practical, address significant technical problems during a stay.

However, we do not guarantee that every interactive effect, prop, sound, light, device, or other immersive feature will operate during every stay.

Temporary failure of an individual immersive feature does not automatically entitle a guest to a full refund.

Any refund, credit, repair effort, or other remedy will depend upon the nature and significance of the problem, applicable reservation terms, and surrounding circumstances.

LI. Security & Technology Tampering

Guests may not intentionally disable, obstruct, disconnect, damage, alter, or interfere with:

  • Exterior security cameras;
  • Video doorbells;
  • Smart locks;
  • Safety equipment;
  • Wi-Fi equipment;
  • Routers;
  • Sensors;
  • Interactive controllers;
  • Immersive systems; or
  • Other property technology.

Guests may be responsible for damage resulting from intentional acts, negligence, misuse, or violation of property rules as provided in the applicable Rental Agreement.

BOOKINGS, PAYMENTS & PROPERTY AVAILABILITY

LII. Direct & Third-Party Bookings

Quarryman’s Rest may accept direct reservations as well as reservations through third-party platforms.

A reservation made through a third-party platform may also be governed by that platform's terms, payment rules, cancellation policies, and procedures. Where a third-party platform's terms control a transaction processed through that platform, those terms will govern to the extent applicable.

LIII. Payments

Direct payments may be processed by third-party payment processors.

You agree to provide accurate payment and billing information and comply with applicable processor terms.

We may require authorization for charges relating to damage, excessive cleaning, missing property, unauthorized guests, unauthorized pets, unauthorized events, or other charges permitted by the applicable Rental Agreement.

LIV. Damage & Missing Property

Guests may be financially responsible, to the extent provided by applicable law and the Rental Agreement, for:

  • Damage beyond ordinary wear and tear;
  • Missing antiques or property;
  • Damage to historical objects;
  • Damage caused by unauthorized handling;
  • Damage to interactive equipment;
  • Excessive cleaning;
  • Unauthorized pets;
  • Unauthorized guests;
  • Unauthorized events;
  • Tampering with security or technology; and
  • Other losses caused by violation of applicable guest terms.

The fact that Quarryman’s Rest encourages interaction with certain objects does not authorize destructive, reckless, or unreasonable use.

LV. Utility & Service Interruptions

Power, Internet, water, weather conditions, telecommunications, third-party services, and other utilities or infrastructure may occasionally be interrupted for reasons outside our reasonable control.

We do not guarantee uninterrupted availability of utilities or third-party services. We will make reasonable efforts to respond appropriately to material problems affecting a stay.

LVI. Cancellation by Quarryman’s Rest

If Quarryman’s Rest must cancel a direct reservation because the property becomes unavailable, unsafe, uninhabitable, or otherwise incapable of reasonably accommodating the stay, we will ordinarily offer, as appropriate:

  • Rescheduling; or
  • A refund of amounts paid directly to Quarryman’s Rest for the affected reservation.

Except where applicable law requires otherwise, we are not responsible for consequential expenses such as airfare, transportation, lost wages, alternate lodging, or other independent travel expenses.

Detailed cancellation and refund policies will appear in the applicable Rental Agreement.

SALES & OTHER SERVICES

LVII. Products, Tickets & Other Transactions

Quarryman’s Rest may offer merchandise, gift cards, digital products, experiences, tickets, memberships, donations, or other goods and services. Additional purchase terms may apply. Prices, taxes, shipping charges, fees, restrictions, expiration terms, and other transaction details may be disclosed at checkout or at the point of purchase.

LVIII. Errors & Fraud

We reserve the right, to the extent permitted by law, to correct obvious typographical, technical, pricing, inventory, or description errors.

We may refuse, cancel, or investigate transactions reasonably believed to involve:

  • Fraud;
  • Unauthorized payment methods;
  • Technical manipulation;
  • Obvious pricing errors;
  • Abuse of promotions; or
  • Other unlawful or improper activity.

If we cancel a paid transaction because of our own pricing or technical error, amounts actually collected for the cancelled transaction will ordinarily be refunded.

DISCLAIMERS

LIX. Site Provided “As Is”

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND GENERAL ONLINE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT:

  • The Site will always be available;
  • Access will be uninterrupted;
  • Every feature will function without error;
  • All content will always be current;
  • Every historical statement will be complete or error-free;
  • Third-party links will remain available;
  • Third-party services will function as expected; or
  • The Site will be free from every technical defect or security threat.

Nothing in this section excludes a warranty or right that applicable law does not permit us to exclude.

LX. Pre-Launch Plans Are Subject to Change

Quarryman’s Rest is currently being restored and developed.

Photographs, renderings, mockups, concepts, restoration plans, proposed amenities, descriptions of future experiences, interactive effects, opening estimates, floor plans, pricing concepts, booking arrangements, and similar pre-launch materials reflect our good-faith plans or intentions at the time they are published.

They are not contractual guarantees that the finished property or experience will be identical.

Restoration discoveries, preservation requirements, safety considerations, technical limitations, costs, permitting, construction conditions, availability, research, guest feedback, or other circumstances may require plans to change.

We may modify, replace, postpone, or discontinue proposed features without liability merely because an earlier version appeared on the Site.

LIMITATION OF LIABILITY

LXI. Limitation for Website Use

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUARRYMAN’S REST, LLC AND ITS OWNERS, OFFICERS, MEMBERS, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO GENERAL USE OF THE SITE.

For a claim arising solely from use of the Site or an online service and not governed by a separate paid-service agreement, our aggregate liability will, to the fullest extent permitted by law, not exceed the greater of:

(a) $25; or
(b) the amount you actually paid directly to Quarryman’s Rest for the particular online service giving rise to the claim.

This limitation does not apply where prohibited by law.

LXII. Non-Excludable Liability

Nothing in these Terms is intended to exclude, waive, or limit liability, duties, remedies, warranties, consumer protections, or other rights that cannot lawfully be excluded, waived, or limited.

Lodging-specific risk allocation and liability provisions may be addressed separately in the Rental Agreement and should not be inferred solely from the website-liability provision above.

INDEMNIFICATION

LXIII. User Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Quarryman’s Rest, LLC and its owners, members, agents, and representatives from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

  • Your unlawful misuse of the Site;
  • Your material violation of these Terms;
  • Fraud or intentional misconduct;
  • Content you submit;
  • Your infringement of another person's rights; or
  • Your violation of applicable law.

This provision does not require you to indemnify Quarryman’s Rest for liability that applicable law prohibits us from shifting to you.

LXIV. Contributor Indemnification

Where you submit historical material or other content, you agree, to the fullest extent permitted by law and subject to any more specific Historical Contribution Agreement, to indemnify Quarryman’s Rest against third-party claims resulting from a material breach of your representations concerning ownership, authority, copyright, permission, privacy, or other rights in the submitted material.

DISPUTES & GOVERNING LAW

LXV. Informal Resolution First

Before initiating a lawsuit concerning these Terms, you and Quarryman’s Rest agree to make a reasonable, good-faith effort to resolve the dispute informally.

A party seeking relief should provide written notice describing:

  • The nature of the dispute;
  • Relevant facts;
  • The requested resolution; and
  • Contact information sufficient to discuss the matter.

The parties will ordinarily have 30 days after receipt of the notice to attempt informal resolution before filing suit.

This requirement does not prevent either party from seeking immediate temporary, injunctive, equitable, or emergency relief when delay could cause irreparable harm or where applicable law otherwise permits immediate action.

LXVI. Governing Law & Venue

These Terms are governed by the laws of the State of West Virginia and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction's non-waivable law applies.

To the fullest extent permitted by law, disputes arising from these Terms that cannot be resolved informally shall be brought in an appropriate state court located in or serving Jefferson County, West Virginia, or an appropriate federal court having jurisdiction over Jefferson County, West Virginia.

Nothing in this section deprives a consumer of a forum or right that applicable law does not permit to be waived.

LXVII. Equitable Relief

Unauthorized use of intellectual property, confidential material, security systems, or other protected rights may cause harm for which monetary damages are inadequate.

Where legally appropriate, either party may seek injunctive or other equitable relief in addition to remedies otherwise available.

GENERAL PROVISIONS

LXVIII. Changes to These Terms

We may update these Terms from time to time as Quarryman’s Rest, our Site, applicable law, or our services change.

The current Terms will display a Last Updated date. Changes apply prospectively unless applicable law permits otherwise. Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms where legally permitted.

When affirmative consent is legally required or appropriate, we may request it separately.

LXIX. Suspension or Discontinuation

We may modify, suspend, restrict, or discontinue the Site or a feature at any time, subject to existing contractual obligations and applicable law.

We do not guarantee permanent availability of any free Site feature.

LXX. Force Majeure

To the fullest extent permitted by law, Quarryman’s Rest will not be responsible for delay or failure to perform an obligation caused by circumstances beyond our reasonable control, including severe weather, natural disaster, fire, flood, utility failure, Internet or telecommunications outage, epidemic or public-health emergency, governmental action, labor disruption, civil disturbance, war, terrorism, supplier failure, transportation interruption, or other comparable event.

This provision does not eliminate refund or other obligations that applicable law or a specific agreement requires.

LXXI. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as necessary, and the remaining provisions will remain in effect.

LXXII. No Waiver

Failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later. A waiver must be express and, where appropriate, in writing.

LXXIII. Assignment

Quarryman’s Rest may assign or transfer these Terms in connection with a merger, sale, financing, reorganization, transfer of assets, change in control, or similar business transaction.

You may not assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

LXXIV. Electronic Communications & Signatures

Where you transact with us electronically, you consent to receive agreements, disclosures, notices, and other communications electronically to the extent permitted by law.

Electronic acceptance, including checking an “I agree” box, clicking an acceptance button, or using another legally recognized electronic method, may constitute your signature and agreement.

You are responsible for maintaining a means of accessing and retaining electronic communications relevant to your transaction.

LXXV. Entire Agreement

These Terms, together with our Privacy Policy and any additional agreement applicable to a particular service or transaction, constitute the agreement between you and Quarryman’s Rest concerning the matters they govern.

Prior or contemporaneous statements do not modify an applicable written agreement unless incorporated into it or otherwise legally binding.

LXXVI. Order of Precedence

If applicable Quarryman’s Rest documents directly conflict, the more specific terms generally control the matter they specifically address.

For example:

  1. A transaction-, promotion-, event-, contribution-, or reservation-specific written agreement controls the subject it specifically governs;
  2. These Terms govern general use of the Site and services; and
  3. Our Privacy Policy governs our handling of personal information.

This hierarchy does not override non-waivable rights under applicable law.

LXXVII. No Third-Party Beneficiaries

Unless expressly stated otherwise, these Terms are intended for the benefit of you and Quarryman’s Rest and do not create enforceable rights in unrelated third parties.

LXXVIII. Survival

Provisions that by their nature should continue after termination or cessation of Site use will survive, including provisions concerning:

  • Intellectual property;
  • Historical contribution licenses;
  • Ownership transfers;
  • Payment obligations;
  • Indemnification;
  • Disclaimers;
  • Limitations of liability;
  • Dispute resolution; and
  • Other accrued rights or obligations.

LXXIX. Headings

Headings are provided for organization and convenience and do not limit or alter the meaning of these Terms.

LXXV. Reservation of Rights

All rights not expressly granted in these Terms are reserved by Quarryman’s Rest, LLC and the applicable rights holders.
